1. Acceptance of Terms

By accessing, connecting your wallet to, or using CryptoQuizzes (the "Platform", "Service", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and CryptoQuizzes. By clicking "I Agree" or by paying the entry fee, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Eligibility and Restrictions

2.1 Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to use this Platform. By using the Service, you represent and warrant that you meet this age requirement.

2.2 Geographic Restrictions

The Platform may not be available in all jurisdictions. You are responsible for ensuring that your use of the Platform complies with all applicable laws in your jurisdiction. The Platform is NOT available to residents of:

  • United States of America and its territories
  • Countries subject to international sanctions (Iran, North Korea, Syria, Cuba, etc.)
  • Any jurisdiction where participation in skill-based gaming for prizes is prohibited
  • Any jurisdiction where cryptocurrency transactions are illegal

By using the Platform, you represent that you are not located in, under the control of, or a national or resident of any restricted jurisdiction.

2.3 Prohibited Conduct

You agree NOT to:

  • Use the Platform for any illegal purpose or in violation of any local, state, national, or international law
  • Violate, or encourage others to violate, any right of a third party
  • Use automated systems (bots, scripts, etc.) to interact with the Platform
  • Attempt to circumvent any security features or access restrictions
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Engage in any form of market manipulation, collusion, or cheating
  • Create multiple accounts to gain unfair advantages (Sybil attacks)
  • Interfere with or disrupt the integrity or performance of the Platform
  • Transmit any viruses, malware, or harmful code

3. Platform Description and Game Mechanics

3.1 Service Overview

CryptoQuizzes is a decentralized skill-based trivia platform where users can participate in timed quiz games by paying an entry fee in cryptocurrency. Winners are determined by score and speed, and prizes are distributed from the entry pool according to predetermined rules executed by smart contracts.

3.2 No Gambling

CryptoQuizzes is a game of SKILL, not chance. Winners are determined solely by knowledge and speed of answering trivia questions correctly. This is NOT gambling, lottery, or games of chance. You acknowledge that outcomes depend entirely on your skill and performance.

3.3 Smart Contract Execution

All game logic, prize distribution, and payments are executed by immutable smart contracts deployed on various blockchain networks. The Platform interface is merely a frontend to interact with these contracts. By participating, you agree to be bound by the smart contract code as deployed.

4. Financial Terms

4.1 Entry Fees

Participation in each quiz session requires payment of a 1 USDT (or equivalent stablecoin) entry fee. This fee is non-refundable except in cases of game cancellation or technical failures as defined in Section 6.

4.2 Prize Distribution

Prize pools are distributed according to the following structure:

  • 70% of the entry pool goes to winners (top 23% of participants by score and speed)
  • 30% retained as platform fee, of which up to 9% may fund referral rewards

Prize distribution among winners is proportional to their rank. The maximum prize per winner is 3 USDT per session, subject to the total prize pool and number of winners.

4.3 No Guaranteed Returns

There is NO guarantee of winning or earning any return on your entry fee. Performance depends entirely on your knowledge, speed, and competition from other players. You may lose your entire entry fee.

4.4 Transaction Fees

You are responsible for all blockchain transaction fees (gas fees) associated with your participation, including entry fee payment, answer submission, and prize claims. These fees are separate from the entry fee and vary by network conditions.

5. Blockchain and Cryptocurrency Risks

5.1 Cryptocurrency Risk Disclosure

By using this Platform, you acknowledge and accept the inherent risks of cryptocurrency and blockchain technology, including but not limited to:

  • Price Volatility: Cryptocurrency values can fluctuate dramatically
  • Irreversible Transactions: Blockchain transactions cannot be reversed or cancelled
  • Loss of Private Keys: Loss of wallet access means permanent loss of funds
  • Smart Contract Risks: Bugs or vulnerabilities in smart contracts could result in loss of funds
  • Network Congestion: High gas fees or transaction delays during network congestion
  • Regulatory Risk: Changing regulations may affect availability or legality
  • Technical Failures: Blockchain network failures or forks

5.2 No Insurance or Protection

Funds deposited or held in smart contracts are NOT insured by any government agency, deposit insurance, or protection scheme. You bear all risks of loss.

5.3 Wallet Security

You are solely responsible for maintaining the security of your cryptocurrency wallet, private keys, and seed phrases. We have NO access to your wallet or funds and CANNOT recover lost keys or reverse transactions.

6. Platform Rights and Limitations

6.1 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. This includes but is not limited to:

  • Game schedules and frequency
  • Prize structures and percentages
  • Supported blockchains and tokens
  • Entry fees and minimum requirements
  • Question content and difficulty

6.2 Account Termination

We reserve the right to restrict, suspend, or terminate your access to the Platform at any time, for any reason, including but not limited to:

  • Violation of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Use of automated systems or bots
  • Multiple account creation (Sybil attacks)
  • Collusion with other players
  • Any conduct we deem harmful to the Platform or other users

Terminated users forfeit any pending prizes or accrued balances. Entry fees for incomplete games may be refunded at our sole discretion.

6.3 Game Cancellation

We reserve the right to cancel any quiz session for reasons including but not limited to:

  • Technical failures or smart contract errors
  • Insufficient participants
  • Suspected cheating or manipulation
  • Question integrity issues
  • Regulatory requirements

In case of cancellation, entry fees will be refunded on-chain. We are not liable for any gas fees or opportunity costs.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
  • ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT
  • UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OPERATION
  • FREEDOM FROM VIRUSES OR OTHER HARMFUL COMPONENTS
  • ACCURACY OF RESULTS OR PRIZE DISTRIBUTIONS

WE DO NOT WARRANT THAT:

  • The Platform will meet your requirements or expectations
  • Access will be uninterrupted or error-free
  • Defects will be corrected
  • The Platform is free of viruses or harmful components
  • Information provided is accurate or reliable
  • Smart contracts are bug-free or secure

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOQUIZZES, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

8.1 Direct Damages

Any loss of funds, profits, revenue, data, or opportunity, whether or not foreseeable, arising from:

  • Your use or inability to use the Platform
  • Smart contract bugs, vulnerabilities, or exploits
  • Incorrect prize distributions
  • Transaction failures or delays
  • Loss of wallet access or private keys
  • Cryptocurrency price volatility

8.2 Indirect Damages

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data or information
  • Loss of business opportunities
  • Cost of substitute services
  • Personal injury or property damage

8.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT OF ENTRY FEES YOU PAID IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS LESS.

9. Indemnification

You agree to indemnify, defend, and hold harmless CryptoQuizzes, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights
  • Your use or misuse of the Platform
  • Your wallet transactions or cryptocurrency activities
  • Any fraudulent, abusive, or illegal conduct
  • Your tax liabilities or reporting failures

10. Tax Responsibilities

You are solely responsible for determining what, if any, taxes apply to your participation in the Platform, including:

  • Income taxes on prizes won
  • Capital gains taxes on cryptocurrency transactions
  • Value-added tax (VAT) or sales tax
  • Withholding taxes
  • Reporting obligations in your jurisdiction

We do NOT provide tax advice and are NOT responsible for determining or reporting your tax obligations. You should consult with a tax professional in your jurisdiction.

11. Intellectual Property

11.1 Platform Ownership

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and smart contracts, are owned by CryptoQuizzes or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

11.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. This license does not include:

  • Commercial use or exploitation
  • Modification, copying, or distribution of content
  • Reverse engineering or decompilation
  • Creating derivative works
  • Framing or linking without permission

11.3 User Content

By using the Platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display any data or information you provide, including wallet addresses and transaction data, for purposes of operating the Platform and improving the Service.

12. Privacy and Data

12.1 Data Collection

We collect minimal personal data. Blockchain transactions and wallet addresses are publicly visible on-chain. We may collect:

  • Wallet addresses (public blockchain data)
  • Transaction history on our Platform
  • Game performance and scores
  • IP addresses and device information
  • Usage analytics

12.2 Data Usage

We use collected data to:

  • Operate and improve the Platform
  • Detect and prevent fraud or abuse
  • Comply with legal obligations
  • Analyze usage patterns and trends
  • Communicate important updates

12.3 No Selling of Data

We do not sell your personal data to third parties. However, blockchain data is inherently public and transparent.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us to attempt to resolve the dispute informally. Send a detailed description of the dispute to our support channel.

13.2 Binding Arbitration

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL BE RESOLVED BY BINDING ARBITRATION, RATHER THAN IN COURT, EXCEPT THAT YOU MAY ASSERT CLAIMS IN SMALL CLAIMS COURT IF YOUR CLAIMS QUALIFY.

Arbitration shall be conducted by a single arbitrator under the rules of a recognized arbitration body. The arbitrator's decision shall be final and binding.

13.3 Class Action Waiver

YOU AND CRYPTOQUIZZES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [JURISDICTION TO BE DETERMINED], without regard to its conflict of law provisions.

14. Severability and Entire Agreement

14.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.2 Entire Agreement

These Terms constitute the entire agreement between you and CryptoQuizzes regarding the Platform and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder. We may assign these Terms without restriction.

15. Updates to Terms

We reserve the right to update, modify, or replace these Terms at any time at our sole discretion. Updated Terms will be posted on this page with a revised "Last Updated" date.

Your continued use of the Platform after any changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically.

IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST STOP USING THE PLATFORM IMMEDIATELY.

  • You are not located in a restricted jurisdiction
  • You understand the risks of cryptocurrency and blockchain technology
  • You understand that outcomes depend on skill and you may lose money
  • You accept all disclaimers and limitations of liability
  • You are responsible for all taxes and legal compliance
